The legal situation and the future of P2P

The legal situation is complicated due to the controversial court decisions in the Napster case. P2P systems themselves do not distribute anything, so they can be accused of "complicity" or "profit-taking" at best. P2P systems tried to use the opt-out system to block songs from the list provided by the copyright holders. However, the court in the Napster case said that this was "not enough." Undoubtedly, some blocked songs could still be found, for example, by typing names with spelling errors in the search. The court decided to use the option to block all works for which P2P does not have the consent of the copyright holders expressed on paper.

However, downloading files via P2P is not illegal under Polish copyright law. This is evidenced by the provisions on permitted personal use in art. 23 of the Polish Law on Copyright and Related Rights. Only the combination of this activity with the distribution of works is a violation of the law of the Republic of Poland.

The future of P2P can be viewed from two sides - technical and legal. As P2P becomes more and more decentralized, and at least because today it is not so easy to determine the purpose of litigation against such networks, even a complete ban will not put an end to the existence of P2P, and may not even be able to significantly reduce it.

Technically, small specialized hub systems (Direct Connect) and systems of large global networks with advanced topology (FastTrack) compete. Data encryption and other privacy-enhancing features are also expected to spread. These priorities are implemented, among others, by the Freenet, MUTE and GNUnet networks.

As the links work faster and faster, the nature of the files being transferred will change. Music, which was originally one of the main P2P content, with SDI and good compression (for example, Ogg Vorbis), can be downloaded in good quality in real time, so music streaming will be less of a problem. Videos are being uploaded more and more, and this trend is expected to continue in the future. In the case of computer programs, two contradictory trends persist: on the one hand, links are getting better, and on the other, programs continue to grow.

Other uses of P2P can also be expected, such as file mirroring (for example, in various Linux distributions) or hosting a personal website distributed using such a system (possibly on Freenet, but hardly used). In the near future, P2P networks will appear, providing complete anonymity for their users. According to these measures, no copyright protection organizations will be able to track people downloading illegal materials from the Internet.
